Introduction

The ISI mark is by far the most recognized product quality certification mark in the Indian subcontinent. The ISI mark is issued by Bureau of Indian Standards (BIS). There are 341 mandatory products which need ISI certification before being sold in India.

How to get ISI Certification in India?

The manufacturer(s) have to complete the testing and documentation required by BIS in order to certify the product with ISI mark. Mandatory Requirements to be Fulfilled by Foreign Manufacturer for ISI Certification

The supplementary requirements to be fulfilled by foreign manufacturers, whose factory(s) location is/are outside India, are specified below:

An application and other necessary documents should be submitted in duplicate.

All foreign manufacturers are considered as ‘Large Scale Business’ according to FMCS criteria.

The applicant (manufacturer) must nominate an Authorized Indian Representative (AIR) for its functioning of BIS license. To nominate an AIR, the applicant (manufacturer) must ensure the ensuing:

⇒ An AIR must be a resident of India

⇒ The nominated Authorized Indian Representative is considered as a representative of one manufacturing firm only and doesn’t represent other foreign manufacturer as AIR under the Bureau of Indian Standards conformity assessment schemes. Although, in case, where foreign manufacturers belonging to one group of companies and importers (related to the foreign manufacturer) nominate as Authorized Indian Representative, the condition of restriction will not be applied in such case.

⇒ Authorized Indian Representative (AIR) must not possess any conflict of interest regarding their role as AIR with examination of sample(s) in third party laboratories.

⇒ Authorized Indian Representative (AIR) should ideally be a graduate at least by qualification and must be able to understand the provisions of BIS Act, 2016, rules and regulations framed here under and the implications therewith.

⇒ Authorized Indian Representative (AIR) must declare his or her assent to be accountable for compliance of the BIS act, rules and regulations as laid down in BIS license, agreement, covenant etc. enacted by or on behalf of the foreign manufacturer with reference to grant and operation of license.

⇒ The name of Authorized Indian Representative (AIR) is inscribed in the license document.

The applicant (foreign manufacturer) should notify preparedness for the examination and should take all actions, like availability of translator, arrangement of air travel tickets, issuance of VISA, transport arrangement of transport in the foreign country, and insurance, etc. for the visiting BIS officer(s) in order to complete the testing assessment at the earliest.

Accountability for timely and safe delivery of sample(s) to the labs and remittance of testing charges lies with the applicant’s (manufacturer’s) firm.

Fees and costs - all remittance should be made in equal USD by applicant (manufacture) from non-SAARC Countries. Payments by the applicant (manufacturer) from South Asian Association for Regional Cooperation (SAARC) Countries (i.e. Afghanistan, Bangladesh, Bhutan, Nepal, the Maldives, Pakistan and Sri Lanka) can be made either in Indian Rupees with GST (as applicable) or in equivalent USD.

Performance Bank Guarantee of USD 10,000 from any bank, having RBI approved branch in India should be furnished, after the grant of license. Performance Bank Guarantee must have a validity of six months - more than the validity of the license.
